5.08.040 - Minors.

A. Sales or gifts of alcoholic beverages to minors are prohibited. No person shall within the city limits of the City of Sisseton give away, sell or in any manner provide intoxicating liquors or malt beverages to any person under the age of twenty-one (21) years or to any person intoxicated or who is in the habit of becoming intoxicated. 

B. Minors are disallowed from the premises of liquor and malt beverage establishments. It shall be unlawful to allow any person under the age of twenty-one (21) years of age to enter, remain in or loiter in an on-sale liquor establishment or malt beverage establishment as well as to enter, remain in or loiter in the City Municipal Liquor Store. It shall be unlawful for any such under-aged person to attempt to gain entrance or enter said establishment or for any person to aid or abet any under-age person in an attempt to gain entrance to or enter into said establishment except as provided in the following instances: 

1. This age restriction shall not apply to malt beverage licensees which obtain more than fifty (50) percent of their gross income from sources other than the sale of malt beverages. If said malt beverage establishment has a specific room exclusively for the sale of malt beverages, minors shall not be permitted to enter said room. 

2. Minors shall be allowed to accompany their parent or parents or any adult so designated by their parent or parents into an on-sale liquor establishment or malt beverage establishment for the purpose of attending a wedding, anniversary or birthday dance or similar function. Minors shall be allowed to accompany their parent or designated person into a restaurant, supper club or other business that serves to the public, even though said business has an on-sale liquor license or malt beverage license. No minor shall be allowed to consume alcoholic beverages or malt beverages while attending any function or business described in this section, even in the presence of the parent or parents or the designated person. 

C. The City Council may grant a variance from any portion of this section upon good cause being shown and not being in conflict with State Law. This variance shall be granted upon good cause being shown. The variance shall be granted for a period not to exceed one year. Any violation of the conditions under which said variance is granted shall be grounds for immediate cancellation of the variance and for any other action deemed necessary by the City.
